The following is an itemized list of hazardous materials violations that have not been <br /> addressed for BlackHawk Petroleum Inc. as of August 19, 2021. <br /> Open violations from July 07, 2021 inspection <br /> Violation#7-Failed to electronically submit an adequate ER procedures for a release or threatened release. <br /> OBSERVATION: The emergency response(ER)procedures have not been submitted for 2021 and was submitted <br /> late for 2019. The emergency response plan is lacking/inadequate. The following information are missing: <br /> -the nearest medical facility/hospital name <br /> -Regional Water Quality Control Board <br /> -Section C11 is blank(Internal Facility Emergency Communications or Alarm Notifications) <br /> -Section C12 is blank(Notifications to Neighboring Facilities) <br /> REGULATION GUIDANCE:A business plan shall include the following emergency response procedures for a <br /> release or threatened release of hazardous materials, including, but not limited to,the following: <br /> -immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice,for the site <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#8-Failed to establish and electronically submit a reasonable or an adequate training program. <br /> OBSERVATION: The employee training plan has not been submitted for 2021 and was submitted late for 2019. <br /> REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br /> the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br /> States Code.An annual electronic submittal satisfies these requirements.The annual business plan shall be <br /> submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the <br /> previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the <br /> current information. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Page 1 of 1 <br />
