Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />July 16, 2021 <br /> Facility Address: <br /> 1210 N Tracy Blvd, Tracy <br /> Facility Name: <br /> O'Reilly Auto Parts #3460 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: Employee Carlos Ordaz was last trained on 7/14/2020. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is a Class II violation. <br /> 19 HSC 25404.1.2 Failed to submit a certification and written response within 30 days for minor violations. <br />OBSERVATION: This facility was inspected on 9/12/2018 and the following minor violations were written: <br />- Failed to complete and/or submit a site map with all required content. <br />The inspection report was delivered to this facility on 9/12/2018. A complete Return to Compliance Certification <br />form was not received by the San Joaquin County Environmental Health Department (EHD) within 30 days of <br />inspection report delivery. The return to compliance information was received by the EHD late on 1/2/2019. <br />REGULATION GUIDANCE: (c) (1) A person who receives a notice to comply detailing a minor violation shall have <br />not more than 30 days from the date of the notice to comply in which to correct any violation cited in the notice to <br />comply. Within five working days of correcting the violation, the person cited or an authorized representative shall <br />sign the notice to comply, certifying that any violation has been corrected, and return the notice to the San Joaquin <br />County Environmental Health Department (EHD). <br />(e) If a person who receives a notice to comply pursuant to subdivision (a) disagrees with one or more of the <br />alleged violations listed on the notice to comply, the person shall provide the EHD a written notice of disagreement <br />along with the returned signed notice to comply.
