The Emergency Response and Training Plans was not submitted for years 2019 and 2020. <br />REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br />the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br />States Code. An annual electronic submittal satisfies these requirements. The annual business plan shall be <br />submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the <br />previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the <br />current information. <br />This is a repeat violation, Class II. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information was not reviewed and resubmitted in the California Environmental <br />Reporting System (CERS) annually by the due date, January 15. <br />- 2021 CERS business plan submittal was submitted late on 1/27/2021. <br />- 2020 CERS business plan submittal was submitted late on 4/21/2020. <br />- 2019 CERS business plan submittal was submitted late on 5/22/2019. <br />REGULATION GUIDANCE: The business plan shall be submitted by January 15 of each calendar year and may be <br />submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Ensure business plan submittals are reviewed and submitted into the CERS at <br />http://cers.calepa.ca.gov/ annually by January 15. <br />This is a repeat violation, Class II. <br />FA0003963 PR0520634 SC001 07/21/2021 <br />EHD 19-01 Rev. 9/16/2020 Hazardous Materials Program OIRPage 3 of 5 <br />1868 E.
