Singh, Sandip [EHD] <br /> From: Singh, Sandip [EHD] <br /> Sent: Monday, March 8, 2021 11A0 AM <br /> To: bellavitabeautybarmanteca@gmail.com <br /> Subject: Notice of Violation - Unpermitted Facility and Practitioner <br /> To Owner/Operator of Bella Vita Beauty Bar: <br /> NOTICE OF VIOLATION <br /> Pursuant to California Health and Safety Code - Safe Body Art Act, it is illegal for a body art practitioner to provide any <br /> body art procedures in San Joaquin County outside of a body art facility that has not been permitted and inspected by the <br /> San Joaquin County Environmental Health Department. <br /> The Safe Body Art Act states: <br /> 11930 - (a) A person shall not perform body art at any location other than a permitted permanent or <br /> temporary body art facility. <br /> Further, it is illegal to perform body art without being registered with the San Joaquin County Environmental Health <br /> Department. <br /> The Safe Body Art Act also states: <br /> 119306- (b)A person shall not perform body art if he or she is not registered with the local enforcement <br /> agency. <br /> Body art is defined as Body Piercing, Branding, Permanent Cosmetics and/or Tattooing. A body art practitioner is defined <br /> as: "a person who performs body art on a client". Please note that this applies whether or not a person receives funds for <br /> the body art. <br /> It has come to our attention that you are advertising to provide body art procedures outside of a permitted and <br /> inspected body art facility,and as such,are in violation of the Safe Body Art Act. You are required to immediately <br /> cease operation of an illegal body art facility and/or the practice of body art, as of the receipt of this notice. Social <br /> media advertisements of permanent cosmetics must also be removed. <br /> Failure to comply with this order and/or to continue to advertise an illegal body art facility will result in the San <br /> Joaquin County Environmental Health Department taking one or more of the following legal remedies against you: <br /> • Issue a Criminal and/or Administrative Citation <br /> • File a Civil and/or Criminal Case <br /> • Seize any and all materials,equipment and other property involved in the body art operation <br /> • Levy fines and/or liens against any real property listed in the names of any individual operating an illegal body <br /> art facility <br /> The Safe Body Art Act states: <br /> 119323 - Performing body art without being registered, performing body art at an unpermitted location, <br /> operating a body art facility without a health permit, or operating a temporary body art event without a <br /> permit shall be a misdemeanor. The local enforcement agency may also assess an administrative penalty in <br /> an amount not less than twenty-five dollars ($25) and not more than one thousand dollars ($1,000)for <br /> 1 <br />
