OBSERVATION: The annual operating permit is not issued to the current operator and there is no written agreement between the person who was issued the permit and the operator to monitor the UST system. REGULATION GUIDANCE: If a permit is issued to a person other than the operator of the tank, that person shall enter into a written agreement with the operator of the tank to monitor the UST system. CORRECTIVE ACTION: Immediately upload the written agreement to the California Environmental Reporting System (CERS)and submit for review by the EHD. This is a minor violation. 115 CCR 2638(c), 2638(d) Failure to submit"Monitoring System Certification Form"within 30 days of completion of the test. OBSERVATION:Annual monitoring system certification, leak detector testing, and spill container testing was performed on 12/23/2020 and a test report was submitted on 4/29/2021, 3 months late. REGULATION GUIDANCE:A copy of the test report must be submitted within 30 days of the tests. CORRECTIVE ACTION: Take all necessary precautions to ensure testing and submittal of test reports are performed in a timely manner. This is a minor violation. 205 CCR 2712(i) Failure to have current UST Monitoring Plan readily accessible at the facility. OBSERVATION:An approved copy of the monitoring plans were not available for inspection. An outdated monitoring plan was observed on site. REGULATION GUIDANCE:A copy of these plans shall be accessible on site at all times. CORRECTIVE ACTION: Immediately locate and retain a copy on site. This is a repeat violation, Class II. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by January 15, 2022 . To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
