<br /> Subject: Accumulation of inert debris located at 18035 N Jacob Brack Rd.,Lodi Ca 95242
<br /> A complaint was received by the Environmental Health Department(EHD)that stated the above property is
<br /> storing a large pile of concrete and debris. The EHD made a site visit on 12/4/19. During the site visit,piles of
<br /> concrete,asphalt,tires,pvc pipes, metal and other solid waste material were observed on the property.
<br /> Title 14, Section 17381 (k) (1)states that:
<br /> (1) "Ty e A Inert debris"includes but is not limited to concrete(including fiberglass or steel reinforcing bar embedded
<br /> in the concrete),fully cured asphalt, glass,fiberglass, asphalt or fiberglass roofing shingles, brick, slag, ceramics,
<br /> plaster, clay and clay products.
<br /> Title 14,Section 17383.7(a)states that:
<br /> All inert debris Type A processing operations sub�1.ect to this Article shall comply with the EA Notification requirements set
<br /> forth in CCR, !Title 4, Division 7, Chapter u%,'Article 3.0 and commencing with section 18100.
<br /> (a) Inert debris storedfor more than 6 months that has not beenprocessed and sorted for resale or reuse shall be
<br /> deemed to have been unlawfully disposed, and therefore subject to enforcement action including the use of a Notice
<br /> and Order as provided in section 18304.
<br /> Title 14, Section 17388 0)states that:
<br /> "Inert Debris Engineered Fill Operation"means an activity exceedin one year in duration in which only the following
<br /> inert debris may be used:fully cured asphalt, uncontaminated concrete g(includmgsteel reinforcing rods embedded in the
<br /> concrete) crushed glass, brick, ceramics, clay and clay products, which may be mixed with rock and soil...The engineered
<br /> fill shall be constructed and compacted in accordance with all applicable laws and ordinances and in accordance with
<br /> s i
<br /> speccations prepared and cert�fied at least annually by a Civil En ineer, Certified Engineering Geologist, or similar
<br /> pro essional licensed by the State of California and maintained in t e operating record of the operation.
<br /> All inert debris being stored at the above location must be processed for reuse or resale or removed to a proper
<br /> recycling/disposal facility within 30 days from the date this notice was received.The EHD will conduct a re-
<br /> inspection of the site on January 15,2020.Failure to comply with this notice may result in further enforcement
<br /> from this department. If the waste is removed and disposed of at an approved disposal facility, then disposal
<br /> receipts must be submitted to the EHD.
