In addition, property owners should contract with a certified <br /> inspector/assessor to perform a dust test at 10-year intervals. <br /> The results of reevaluations and visual surveys and any corrective measures taken must <br /> be documented and kept as permanent records and made available to prospective tenants <br /> or buyers of the property. <br /> On March 6, 1996, the Environmental Protection Agency (EPA) and the Department of <br /> Housing and Urban Development (HUD) published a final rule titled "Lead: <br /> Requirements for Disclosure of Known Lead-Based Paint and/or Lead-Based Paint <br /> Hazards in Housing" (40 CFR Part 745). To be in compliance with the rule, landlords <br /> and sellers must complete the following activities before the lessee or buyer is obligated <br /> under any contract to lease or buy the dwelling unit: <br /> • Give prospective tenants or buyers a copy of the pamphlet entitled "Protect Your <br /> Family From Lead in Your Home," (EPA #747-K-99-001). <br /> • Disclose to each prospective tenant or buyer any records, reports or known <br /> information pertaining to the presence of lead-based paint and/or lead-based paint <br /> hazards; and <br /> • Completely fill out a disclosure form to confirm that the lessee or the buyer has <br /> received the necessary disclosure materials.
