OBSERVATION: This farm business does not meet the requirements for exemption from filing emergency response (ER)procedures in the California Environmental Reporting System (CERS).The Contingency Plan in CERS does not list the CUPA phone number(209)468-3420. The Emergency Response Plans and Procedures were not submitted to CERS for year 2019, 2020, and 2021. ---------------------------------------------------------------------------------------------------------------------------------------------------- REGULATION GUIDANCE: To meet this exemption, a farming business shall: -annually submit the Hazardous Materials Inventory -mark each building that stores any pesticides, petroleum fuels and oil, or fertilizers with warning signs -provide training for all employees in safety procedures in the event of a release or threatened release of a hazardous material. Per H&SC 25508.2, the business owner/operator shall annually review and certify that the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United States Code.An annual electronic submittal satisfies these requirements.The annual business plan shall be submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. ---------------------------------------------------------------------------------------------------------------------------------------------- CORRECTIVE ACTION(S): Immediately take all steps to meet the requirements for exemption from filing emergency response procedures, or log into the CERS at http://cers.calepa.ca.gov/, and upload emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to,the following: -immediate notification of local emergency personnel and the Environmental Health Department(EHD) -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment -evacuation plans and procedures, including immediate notice,for the site.
