The training program was submitted late for the year of 2020. <br /> REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br /> the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br /> States Code.An annual electronic submittal satisfies these requirements.The annual business plan shall be <br /> submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the <br /> previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the <br /> current information. <br /> This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15. The facility, inventory, and plans <br /> section of the Hazardous Material Business Plan (HMBP)was last submitted on 1/16/2020.The HMBP was <br /> submitted late for the year of 2020.The facility, inventory, and plans sections of the HMBP have not been submitted <br /> for the year of 2021. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br /> information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection report was provided to the facility operator on the day of inspection. The report was amended on <br /> 8/13/2021 and replaces the initial report on 8/11/2021. The inspection report completed on 8-11-2021 said no <br /> violations were found at time of inspection. Further review has determined the Hazardous Material Business <br /> Plan (HMBP) has not been submitted for the year of 2021. This is why violations 4, 5, 6, 7, 8, and 9 have been <br /> added to the inspection report. More details are provided in the comment section for each violation. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 9/12/2021 <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign.
