A formal inspection was conducted on 4/20/2021. The <br /> facility is required to have the foundation inspected by a structural engineer and recommend a repair plan. <br /> REGULATION GUIDANCE: (c)(1)Not use a container for the storage of oil unless its material and construction are <br /> compatible with the material stored and conditions of storage such as pressure and temperature. <br /> CORRECTIVE ACTION: Immediately provide proof that the required repairs have been completed. Submit proof of <br /> correction to the EHD. <br /> This is a Class II violation. <br /> 714 CFR 112.8(c)(8)(kiv) Failed to provide each container with a high level monitoring device. <br /> OBSERVATION: High level monitoring devices for each fixed above ground storage tanks were not discussed in <br /> the SPCC plan dated 4/11/2020. <br /> REGULATION GUIDANCE: (c)(8)Engineer or update each container installation in accordance with good <br /> engineering practice to avoid discharges.You must provide at least one of the following devices: <br /> (i) High liquid level alarms with an audible or visual signal at a constantly attended operation or surveillance station. <br /> In smaller facilities, an audible air vent may suffice. <br /> (ii)High liquid level pump cutoff devices set to stop the flow at a predetermined container content level. <br /> (iii)Direct audible or code signal communication between the container gauger and the pumping station. <br /> (iv)A fast response system for determining the liquid level of each bulk storage container such as digital computers, <br /> telepulse, or direct vision gauges. If you use this alternative, a person must be present to monitor gauges and the <br /> overall filling of bulk storage containers. <br /> CORRECTIVE ACTION: Ensure that an approved liquid level sensing device is installed on all tanks in accordance <br /> with CFR 112.8 and ensure that the SPCC plan discusses the liquid level device for each tank and frequency of <br /> inspections to ensure that this device is fully functional and in use at all times during tank's filling operations, provide <br /> proof of correction to the EHD. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> FA0000527 PR0516677 SCO01 07/06/2021 <br /> EHD 28-01 Rev.9/16/2020 Page 4 of 5 Aboveground Petroleum Storage Act OIR <br /> 1868 E.
