ROTH RD., FRENCH CAMP, CA 95231. <br />OBSERVATIONS: <br />A spill of approximately 1 gallon of green liquid occurred at Union Pacific Railroad rail yard on track #703 on July 27, 2019 <br />and was reported to the Office of Emergency Services by Madonna Riggenbach of Union Pacific Railroad. Per Union <br />Pacific, the spill was cleaned up by Patriot Environmental Services on July 27, 2019. According to Joseph McGuffin of <br />Patriot Environmental, all damaged containers and rags were placed back into trailer and the material was characterized as <br />non-hazardous as indicated by the placard. However, Safety Data Sheets were reviewed. Power Stick 3 in 1, Arm and <br />Hammer Essentials Body Wash, Arm and Hammer Ultra Max Body Wash, and Power Shower Gel have aquatic toxicity <br />properties. <br />Provide determination for the waste and disposal records. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit final disposal records to the EHD. <br />Other Correction <br />EHD 25-01 Rev. 08/17/17 Page 1 of 2 <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />1868 E.
