Approximately 10 gallons of gasoline was released from an automobile accident. Spill site covers an approximate <br />area of 12x12 inches in soil and is approximately 30 feet from roadway on private property. No waterways or storm drains <br />impacted. CHP marked off area with spray paint. Site is pending clean-up. CHP unable to contact property owner. <br />Responsible party to investigate and abate contamination immediately. Responsible party to notify SJC EHD when clean-up <br />will occur and when clean-up is completed for verification. Responsible party to provide SJC EHD with copy of disposal <br />record for waste generated from the clean-up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />ci Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />0 Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Within 30 days. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
