(209) 831-6300 <br />Program Element: 3616 - PUBLIC POOL/SPA- EXEMPT <br />Inspection Type: ROUTINE INSPECTION - Operating Permit <br />VIOLATIONS AND CORRECTIVE ACTIONS <br />Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code section(s) 116043, 116040, & <br />116050. All violations must be corrected within specified timeframe. Violations that are classified as "MAJOR" pose an immediate threat to public health <br />and must be corrected immediately or be subject to closure pursuant to California Code of Regulations (Title 22) section 65545. <br />#2 Pool Enclosure <br />OBSERVATIONS: Fence lacks bottom restraints to pole in two locations (in a row). Reinstall restraints today. <br />VIOLATION DESCRIPTION: Pool area shall be enclosed by one or more of the following: a fence, portion of a building, wall, or other <br />approved durable enclosure. Pool enclosure shall be constructed over a hard permanent material equivalent to concrete and shall be <br />installed no more than 2 inches above the finished grade. Holes, gaps, or openings in the enclosure shall not allow the passage of a <br />4 -inch diameter sphere. Doors, openable windows, or gates of living quarters shall not be permitted as part of the pool enclosure. (CBC <br />31198) Pool operator shall keep the pool enclosure well maintained. (CCR 65535) Pool enclosure shall have a minimum effective <br />perpendicularheightof 5 feet and shall be constructed so that it cannot be climbed by small children. Horizontal members shall be spaced <br />at least 48 inches apart. No planters or other climbable structures shall be permitted within 5 feet of the pool enclosure or within a 5 -foot <br />arc. Chain link openings shall not be larger than 1314 inches when measured horizontally. Pool enclosures with a height of 4 or more feet <br />are allowed if the enclosure was constructed prior to July 1994. Maintain an active <br />mosquito abatement plan (mosquito fish may be already added). <br />The person in charge is responsible for ensuring that the above mentioned facility is in compliance with all applicable sections of the California Health and <br />Safety Code.
