Describe specifics below <br />Other: Describe specifics below. <br />Summary of Incident and Justification for not taking an Enforcement Action: <br />On May 6, 2019, I, Biologist Dagenbach, was conducting routine surveillance and noticed an application taking <br />place in an Almond orchard. I performed an inspection at 10:27 AM, on a worker using an airblast sprayer to <br />apply pesticides. I inspected who was an employee for C & A Navarra Ranch. During the <br />inspection, I found three violacont' s. The violations found involved missing PPE(safety glasses) which were <br />required by the label, and no decontamination kit. The PPE and decontamination kit were missing because <br />-left it in another tractor. I marked non -compliances for 3CCR 12973, 3CCR 6738, and 3CCR 6734. <br />During the inspection, the property operator and supervisor, Mr. Navarra(PAC# 3998401), showed up. I <br />explained the violations and had Mr. Navarra sign off on the inspection.The decontamination kit and glasses <br />were brought to the site by Mr. Navarra. I told Mr. Navarra I would contact him within thirty days to perform a <br />headquarters inspection. <br />On June 13, 2019, at 10:00 AM, I was accompanied by Biologist Gill to C & A Navarra Ranch headquarters, to <br />perform an inspection. Mr. Navarra and from Cal Ag safety, were present during the entire <br />inspection. During the inspection, no violations were found. I explained the need for decontamination kits and <br />all required PPE. Although the applicator was in an enclosed cab, and exempt from certain PPE requirements, <br />PPE as required by the label must be available at the use site. In order to mitigate and avoid future non - <br />compliances, Mr. Navarra stated he would personally make sure before starting an application that workers <br />have decontamination kits and that required PPE would be present at all use sites. <br />The initial use inspection resulted in three class B violations. This is C & A Navarra Ranches first class B <br />violations within the past two years. No Injury or illness occured due to these non -compliances.
