OBSERVATION: The emergency response(ER)procedures did not include all the required information. The emergency response/contingency plan in CERS did not list the CUPA phone number(209)468-3420.This entry was left blank. REGULATION GUIDANCE:A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to,the following: -immediate notification of local emergency personnel and the Environmental Health Department(EHD) -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment -evacuation plans and procedures, including immediate notice,for the site CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. The 2018 submittal was late. Facility information only was submitted on 1/24/18 and a complete submittal was received on 2/20/18. The 2020 submittal was late.The facility information only was submitted on 2/12/20 and a complete submittal was received on 2/28/20. The 2021 complete submittal was late. Facility information and Hazardous Materials inventory were submitted on time on 1/14/2021.A complete submittal with the Emergency Response and Training Plan was received on 2/24/2020. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 5 violations during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 9/30/2021. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
