1 3. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />2 are doing business in the State of California, in the course of Defendant's business of FURNITURE <br />3 STORE activities, are pursuant to Health and Safety Code section 25181 hereby permanently <br />4 enjoined from: <br />5 a. Disposed or caused the disposal of a hazardous or extremely hazardous waste at a <br />6 point which is not authorized, in violation of Health and Safety Code section 25189.2(c). <br />7 4. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br />8 are doing business in the State of California, in the course of Defendant's business of FURNITURE <br />9 STORE activities, are pursuant to California Business and Professions Code, section 17204 hereby <br />10 permanently enjoined from: <br />11 a. Violating Health and Safety Code section 25100 et seq., described in paragraph <br />12 3 — 3a above; and <br />13 b. Discharged sewage or other waste, or the effluent of treated sewage or other waste, <br />14 in any manner which will result in contamination, pollution, or a nuisance, in violation of Health and <br />15 Safety Code section 5411. <br />16 5. Defendants shall pay to Plaintiff the sum of TWO THOUSAND FIVE HUNDRED <br />17 DOLLARS ($2,500.00), as and for civil penalties, pursuant to Health and Safety Code §25192: <br />18 a. $ 1,250.00 made payable to the DEPARTMENT OF TOXIC SUBSTANCE <br />19 CONTROL — TOXIC SUBSTANCE CONTROL ACCOUNT, as follows: <br />20 $ 100.00 — 18 months after the date of signing <br />21 $ 900.00 — 24 months after the date of signing <br />22 $ 250.00 — 30 months after the date of signing <br />23 b. $ 625.00 made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br />24 HEALTH DEPARTMENT — ENVIRONMENTAL HEALTH DIVISION TRUST, 30 months after <br />25 the date of signing; and <br />26 c. $ 625.00 made Payable to the SAN JOAQUIN COUNTY OFFICE OF THE <br />27 DISTRICT ATTORNEY, 30 months after the date of signing. <br />28 Said payments shall be delivered to the San Joaquin County Office of the District Attorney, <br />-2— <br />PRRMANF.NT INII INCTION AND FINAL IUDCYMENT PURSUANT TO STIPULATION <br />
