I have a concern with <br /> EHD's Condition No. 4. <br /> When Mike read the Conditions when they first were published, he read No. 4 in a <br /> similar manner as No. 3. That is to say No. 3 required action at time of development <br /> (installing a septic system) but No. 4 requires the action (digging a new well) prior to the <br /> recordation of the map. He didn't notice the part regarding prior to recordation of the <br /> map or I would have brought this up sooner. <br /> The Lagorio family has owned this property (and contiguous property) for over 50 years. <br /> When the original parcel was created in 2002 (PA-0200074), the intent, was to have <br /> both houses on the same parcel because the owner was living in the small house while <br /> he was building his new house. Nothing has changed since 2002 except now a "Key <br /> Man" employee resides in the smaller house. Parcel 1 and the "Unsurveyed Reminder" <br /> parcel will still be owned by the same owner (Lagorio). Again, the Lagorio family is a <br /> farming family, and this parcel is an integral part of the family operation. They have no <br /> plans either in the short or in the long term to sell the property. <br /> The situation is similar to one you and I discussed recently (PA-2200014) where the <br /> same owner owned both parcels. We agreed that a Property Owner's Water License <br /> Agreement would be allowed which essentially states that once either parcel is sold, a <br /> new well will be required prior to close of escrow. It is a recorded, binding document <br /> that would show up in any Preliminary Title Report. <br />
