A business plan shall include the following <br /> emergency response procedures for a release or threatened release of hazardous materials , including , but not <br /> limited to , the following : <br /> - Immediate notification of local emergency personnel and the Environmental Health Department ( EHD) <br /> - Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons , property, or the environment <br /> - Evacuation plans and procedures , including immediate notice , for the site <br /> Immediately log into the California Environmental Reporting System ( CERS) at http : //cers , calepa , ca . gov/, upload the <br /> correct or updated information , and submit to the EHD for approval . <br /> This is a Class II violation. <br /> 9 HSC 25508 . 2 Failed to annually review and certify that the business plan is complete , accurate , and up to date . <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System ( CERS) annually . The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year . Immediately log into the CERS at <br /> http : //cers , calepa . ca , gov/, enter the correct or updated information , and submit to the EHD for approval . <br /> This is a Class II violation. <br /> 12 HSC 25505 (c) Failed to have the business plan readily available to facility or EHD personnel . <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request . The emergency <br /> response plans and procedures , the inventory of information required by this article , and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section . Immediately make arrangements to have the business <br /> plan readily available for review. <br /> This is a Class II violation. <br /> Overall Inspection Comments : <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation , and any supporting <br /> paperwork , within 30 days of receiving the completed inspection report . <br /> At this location since at least 2014 . <br /> Assisted with CERS account setup and submittal of the Facility Information Section at the time of inspection . <br /> Please be aware as of January 1 , 2013 , all businesses were required to submit all hazardous materials <br /> information online to the California Environmental Reporting System (CERS) at http : //cers. calepa . ca . gov .
