CONDITIONS OF APPROVAL <br /> PA- 2100200 <br /> SERAY INVESTMENT COMPANY , LLC / TONI RAYMUS <br /> Minor Subdivision Application No . PA- 2100200 was approved by the Community Development <br /> Department on January 4 , 2022 . The effective date of approval is January 14 , 2022 . This tentative map <br /> approval will expire on January 13 , 2025 , which is three ( 3 ) years from the effective date of approval , <br /> unless ( 1 ) all Conditions of Approval have been complied with and ( 2) a Parcel Map has been filed with <br /> and accepted by the County Surveyor . <br /> Unless otherwise specified , all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map . TENTATIVE MAP : The Parcel Map shall substantially conform with the approved tentative map dated <br /> September 9 , 2021 . <br /> b . RIGHT TO FARM : Pursuant to San Joaquin County Code Section 6 - 9004 ( b ) , the following note shall <br /> be placed on the Parcel Map and recorded as a separate instrument : <br /> ( 1 ) All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities , such <br /> as noise , odors , insects , dust or fumes . San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance . <br /> c . LOT SIZE AND WIDTH : The following lot size regulations shall apply to this map : <br /> ( 1 ) All parcels shall have a minimum lot area of 2 acres . <br /> ( 2 ) All parcels shall have a minimum lot width of 150 feet , measured at the front yard setback line . <br /> d . PROPERTY LINE SETBACK : (the following requirements shall apply) <br /> ( 1 ) The proposed new side property lines for Parcels Three and Four shall meet the side yard setback <br /> requirements for the AU - 20 ( Agriculture — Urban Reserve , 20 - acre minimum ) zoning designation <br /> for structures . HOLD HARMLESS PROVISION : Pursuant to Section 66474 . 9 of the Government Code , the <br /> subdivider shall defend , indemnify , and hold harmless the local agency or its agents , officers , and <br /> employees from any claim , action , or proceeding against the local agency or its agents , officers , or <br /> employees to attack , set aside , void , or annul an approval of the local agency , advisory agency , appeal <br /> board , or legislative body concerning a subdivision , which action is brought within the time provided <br /> for in Section 66499 . 37 of the Government Code . <br /> 3 .
