Box 21119 <br />Houston TX 77226 <br />Attn: Gary Stein <br />Re: Notification of Potential Filing of Administrative Enforcement ®rder <br />Dear Mr. Stein,, <br />On February 3, 2017 representatives of the San Joaquin County Environmental Health <br />Department ( EHD"), which is the certified unified program agency ("CUPA") in this <br />jurisdiction, conducted a Hazardous Materials Program inspection at 450 Poi 1 Road 23 <br />Stockton CA 95203 (hereinafter "Facility") and issued a report of violations. <br />During the inspection, EHD discovered violations of law and, based on those findings, EHD is <br />prepared to bring an administrative action against you pursuant to California Health and <br />Safety Code Section 25404.1.1. The administrative action is to ensure compliance with <br />applicable statutes and assess penalties for violations. A copy of the inspection report and a <br />non -Compliance letter identifying outstanding violations, are enclosed. <br />EHD has found that <br />the Facility is/was in violation of the following regulations: <br />1. HSC 25505, 25508(x)(1) Failed to complete and electronically submit a hazardous <br />materials business plan <br />2. HSC 22507 Failed to establish and implement a hazardous materials business plan <br />3. HSC 25508(x)(1) Failed to cornplete and/or subrnit the Business Activities or <br />Owner/Operator Identification page <br />4. HSC 25506(x) Failed to complete and/or submit hazardous materials inventory for <br />all reportable materials on site <br />5.
