Nso : <br /> The intent of this letter is to respond to the item ( s ) you noted on your Inspection Report issued to the <br /> location referenced above dated 09/24/2021 and 10/ 14/2021 both received on 10/ 14/2021 . <br /> Item 107 : On your inspection report you noted that a copy of 7 - Elevens current financial responsibility <br /> document was not available on site for review . Your inspection report noted HSC 25292 . 2 and CCR <br /> 2711 ( a ) ( 11) for reference . <br /> Resolution 107 : 7- Eleven believes this violation to have been written in error and would respectfully <br /> request it be removed/ rescinded from the report . 7 - Eleven makes efforts to have the current financial <br /> responsibility documents on site for efficiency, but they are not required to be maintained at the facility . <br /> The regulation codes noted on the inspection report pertain to the requirement to have evidence of <br /> financial responsibility ( HSC 25292 . 2 ) , and information and allocation requirements for a permit to <br /> operate ( CCR 2711 ( a ) ( 11 ) ) . Specifically, these provisions state : <br /> California Health and Safety Code — 25292 . 2 : <br /> "(a) All owners and operators of an underground tank system shall maintain evidence of <br /> financial responsibility for taking corrective action and for compensating third parties for <br /> bodily injury and property damage caused by a release from the underground tank system, in <br /> accordance with regulations adopted by the board pursuant to Section 25299. 3. The <br /> regulations shall include a schedule that requires that financial responsibility requirements are <br /> phased-in for all underground storage tank systems on or before October 26, 1990. <br /> (b) If the owner and the operator are separate persons, either the owner or the operator shall <br /> demonstrate compliance with subdivision (a). <br /> (c) An owner may comply with this article by entering into an agreement with the operator of <br /> the tank requiring the operator to demonstrate compliance with subdivision (a).
