FINDINGS FOR DEVIATION PA-2100159 GLEN A. RIGSBEE 1. The granting of the Deviation will not be materially detrimental to other properties or land uses in the area. • This finding can be made because the continued use of the property will remain commercial and enclosed and open storage additions to the existing building are a permitted use in the C-G (General Commercial) zoning designation. Therefore, this request will not have a detrimental effect on other properties or land uses in the area. 2. There are exceptional circumstances or conditions applicable to the property or to the intended uses that do not apply to other properties in the same zoning district in the vicinity. • This finding can be made because the proposed property is zoned C-G (General Commercial), and there are limited locations on-site to place a storage addition to the existing building due to the location of the existing improvements, required storm drainage, and required fire access. In addition, other properties in the area under the same zoning have existing structures with setbacks that are less than the required 20 foot side yard setback for commercial properties abutting property developed with conforming residential uses, property zoned residentially, or property shown on the General Plan Map for residential development. The structure will still be setback 14 feet 6 inches from the residential property to the south. 3. The strict application of the regulation deprives the property of privileges enjoyed by other properties in the vicinity. • This finding can be made because other properties in the area under the same zoning contain existing buildings with setbacks that are less than the required 20 foot rear yard setback for commercial properties abutting property developed with conforming residential uses, property zoned residentially, or property shown on the General Plan Map for residential development. 4. The granting of the Deviation is consistent with the General Plan. • This finding can be made because the Deviation does not permit an increase in the General Plan Floor Area Ratio for General Commercial properties, nor does it change any intended use permitted for properties under this designation.
