Timing: Prior to approvals and prior to issuance of development permits. <br />4. Fees: <br />General. Development within the project shall be subject to the payment of all applicable and lawfully <br />enacted County fees, subject to the provisions of the Master Plan Development Agreement (i.e., the <br />Amended and Restated Master Plan Development Agreement By and Between County of San Joaquin <br />and Trimark Communities Relative to the Development of Certain Property Within the Mountain House <br />Community {"Development Agreement")) and the Specific Plan I I Development Agreement (Specific <br />Plan 11 Addendum to Development Agreement By and Between County of San Joaquin and Trimark <br />Communities, LLC and Subsequent Development Agreement By and Between County of San Joaquin <br />and Trimark Communities, LLC Relative to the Development of a Portion of the Mountain House <br />Community (Specific Plan ll)) {" SPII Development Agreement))). [Development Agreement Section <br />2.5.3] <br />Specific. The applicant for all subsequent development within Neighborhoods I & J shall pay the <br />Affordable Housing Impact Fee in effect at the time of building permit approval. [Development <br />Agreement Section 2.5.3; SPII Development Agreement, Exhibit B-1 I; and Mountain House <br />Development Title Chapter 9-1270M] <br />If a Countywide agricultural mitigation fee were established, an agricultural mitigation fee, based on <br />each agricultural acre converted to an urban use, shall be paid by the developer to the County as <br />specified in the ordinance. Any lands that have a recorded Final Map prior to the adoption of an <br />agricultural mitigation fee shall not be subject to the fee. [SP II Implementation Measure 3.3.4 (3)] <br />5. Final Map Digital File: A digital file of the Final Map shall be submitted to the Community Development <br />Department. The digital file format shall be consistent with requirements of the County Assessor and <br />Community Development Department GIS division. <br />Timing: prior to approval of Final Map(s). <br />6. Road Names: All subdivision road names shall be submitted to the Community Development <br />Department for approval by the Director. Said road names shall comply with the "Standards for Road <br />Names and Road Name Changes, Public and Private" of San Joaquin County. [Development Title <br />Section 9-1150.18] <br />7. Monitoring Program: The Final Map(s) shall comply with the attached Mountain House Master Plan <br />and Specific Plan 1 San Joaquin County Mitigation Monitoring Program. <br />8. Monitoring Agreement: The applicant or the applicant's assignee shall fund the Community <br />Monitoring and Mitigation Monitoring Programs. The applicant or the applicant's assignee shall also <br />fund the County's efforts to monitor compliance with the Tentative Map conditions of approval. [General <br />Plan Community Organization and Development Policy (19)(j)] <br />Timing: Ongoing. <br />LAND USE <br />9. Residential Areas: Portions of rResidential areas (except R/VL) within Neighborhoods l -and J shall be <br />developed as Active Adulta egg , estricte-d housing_ for seniers. Restrictions shall be imposed on these <br />designated areas which specifically prohibit school age persons from living in these restricted units. <br />[SPII Implementation Measure3.3.8 (2)] <br />Timing: Condition shall be met prior to recordation of each Final Map in Neighborhoods I and J with <br />residential areas. <br />10. Second Unit Dwellings: Second unit dwellings shall be required on at least 6.5 % of the parcels within <br />Resolution Template 01/2017 <br />
