The following is an itemized list of hazardous materials violations that have not been addressed for STOCKTON POPEYES as of December 14 , 2021 . Open violations from October 07 , 2021 inspection Violation #2 - Failed to initially complete and electronically submit a HMBP . OBSERVATION A complete Hazardous Materials Business Plan was not submitted electronically to the California Environmental Reporting System ( CERS ) . REGULATION GUIDANCE: As of January 1 , 2013 , all businesses were required to submit all business plans electronically . CORRECTIVE ACTION : Immediately log into the CERS at http : //cers . calepa . ca , gov/ , enter the correct or updated information , and submit to the EHD for approval . ❑ This violation was corrected ❑ This violation will be corrected by ( date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #3 - Failed to establish and implement a hazardous materials business plan . OBSERVATION A Hazardous Materials Business Plan has not been established or implemented . REGULATION GUIDANCE: A Hazardous Materials Business Plan ( HMBP ) shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids , 500 pounds for solids , or 200 cubic feet for compressed gas , at standard temperature and pressure . CORRECTIVE ACTION : Immediately log into the California Environmental Reporting System ( CERS ) at http : //cers. calepa . ca . gov/, enter the required information , and submit for review by the EHD . /Submit a statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented . ❑ This violation was corrected ❑ This violation will be corrected by ( date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #6 - Failed to electronically submit a site map with all required content. OBSERVATION A site map was not completed and submitted as part of the business plan . REGULATION GUIDANCE: A site map shall contain a north orientation , loading areas , internal roads , adjacent streets , storm and sewer drains , access and exit points , emergency shutoffs , evacuation staging areas , hazardous material handling and storage areas , and emergency response equipment. If a site map element is not applicable for your facility then list it on the map and label as " NA" . CORRECTIVE ACTION : Immediately log into the California Environmental Reporting System ( CERS ) at http : //cers . calepa . ca . gov/ , upload the correct or updated information , and submit to the EHD for approval .
