S A N J D AR I N Environmental Health Department <br /> (L)j ;"� 1 Y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> CHARTER WAY PETRO INC. 508 W DR MARTIN LUTHER KING JR BLVD, October 13, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection for the following manifests; <br /> -006952093SKS, ship date 8/1/2019 <br /> -007181573SKS, ship date 8/1/2019 <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by getting a copy via email, printing and <br /> placing on site with other manifests. No further action is required to correct this violation. <br /> This is a repeat violation, Class II. <br /> 401 CCR 66262.34(d)(2) Failed to store hazardous waste in a container that is in good condition. <br /> OBSERVATION: Hazardous waste was found stored on-site in containers that are not in good condition. <br /> -one 55-gallon metal drum of fuel contaminated liquids was observed with rusting on the top and side of the drum, <br /> the side of the drum can be chipped off. <br /> REGULATION GUIDANCE: Hazardous waste shall be stored in a containers that are in good condition. If a <br /> container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it <br /> begins to leak,the owner or operator shall transfer the hazardous waste from this container to a container that is in <br /> good condition, or manage the waste in some other way that complies with the hazardous waste requirements. <br /> CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition. <br /> Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: <br /> -one 55-gallon metal drum of fuel contaminated solids was observed without a bolt to securely fasten the drum lid <br /> closed. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
