Paint Cans On Premises. <br />A complaint (C00054042) has been received by this office alleging that the tenant is painting cars with <br />a paint sprayer gun, causing paint to be sprayed everywhere, and paint cans are on premises. <br />The California Health and Safety Code (HSC) §25505 requires that facilities prepare a Hazardous <br />Materials Business Plan (HMBP) if they handle reportable quantities of hazardous materials at any given <br />time in the year. Reportable quantities are 500 pounds for a solid, 55 gallons for a liquid, and 200 cubic <br />feet for gas. If your facility stores hazardous materials at or above these quantities, an HMBP permit <br />must be obtained with the EHD. <br />If these chemicals are no longer in use and are hazardous wastes, they must be handled and disposed <br />of according to all applicable rules and regulations. Please be advised, the California Code of <br />Regulations (CCR), Title 22 § 66260.10 defines a hazardous waste "generator" as any person, by site, <br />whose act or process produces hazardous waste or whose act first causes a hazardous waste to become <br />subject to the hazardous waste regulations. Facilities that generate hazardous wastes are subject to all <br />hazardous waste regulations and permitting requirements with the EHD. <br />Please be advised that the disposal of any hazardous waste, or the causing thereof, is prohibited when <br />the disposal is at a facility that is not permitted or authorized for hazardous waste disposal [HSC <br />25189.5 (a).]. A hazardous waste determination must be made per CCR 66262.11 for all generated <br />hazardous wastes. <br />Property owners are responsible for the clean-up of hazardous wastes located on their property. <br />Immediately secure any open or leaky hazardous waste containers, label them, and dispose of all <br />hazardous wastes, as required. Licensed hazardous waste transporters can be found here: <br />https://hwts.dtsc.ca.gov/transporters/. <br />Small amounts of hazardous waste can be transported for disposal to the San Joaquin County <br />Household Hazardous Waste (HHW) facility, located at 7850 R.A. Bridgeford Street, Stockton, CA <br />95206. The facility has limited hours of operation; more information can be found here: <br />https://www.sjgov.org/solidwaste/hhw or in the included brochure. <br />All EHD follow-up time for confirmed complaints is billed to the property occupant or owner at <br />the current Environmental Health Department rate of $152 per hour. Subsequent complaints <br />related to this matter may require another site visit by an Environmental Health inspector. <br />1868 E.
