TRACY <br />Date: <br />August 23, 2021 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # Remarks <br />113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br />OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste <br />transported from the site in the past three years. The missing receipts include: <br />- Manifest# 009964385FLE, Ship Date: 2/19/2019, Waste Code 213 <br />- Manifest# 010249582FLE, Ship Date: 8/6/2019, Waste Code 213 <br />- Manifest# 010249651FLE, Ship Date: 10/23/2019, Waste Code 213 <br />REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br />This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br />the regulated activity or as requested by the department or a certified unified program agency. <br />CORRECTIVE ACTION: Locate a copy of the receipts listed above. Maintain the records on-site for three years <br />from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department (EHD). <br />If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for <br />three years. <br />This is a Class II violation. <br />119 HSC 25404(e)(4) Failed to report accurate program data in the California Environmental Reporting System (CERS). <br />OBSERVATION: This business's hazardous waste activities have not been reported on the California <br />Environmental Reporting System (CERS) website (https://cers.calepa.ca.gov/). <br />REGULATION GUIDANCE: Each regulated business shall report program data electronically on the CERS website <br />(https://cers.calepa.ca.gov/). <br />CORRECTIVE ACTION: Immediately report your business activities including the hazardous waste program on the <br />CERS website (https://cers.calepa.ca.gov/). Provide a corrective action statement to the San Joaquin County <br />Environmental Health Department within 30 days. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 9/22/2021. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($152).
