SAN JOAQUIN <br />—COUNTY-- <br />Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: ESTES EXPRESS LINES INC <br /> Date: Jul 21, 2020 <br />RP Mailing Address: PO BOX 25612 <br /> Record ID#: CO8XHF1N6 <br />RICHMOND, VA 23260- Program Element: 2546 <br />Spill Location: 6540 S AUSTIN RD, STOCKTON <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />APPROXIMATELY ONE- QUART OF EITHER TOLUENE OR SODIUM HYDROXIDE LEAKED FROM ESTES EXPRESS <br />RAIL CAR CAL OES REPORT #20-3863. BNSF PERSONNEL LATER DETERMINED THE LEAK WAS COMING FROM <br />A DAMAGED CONTAINER OF PETROLEUM COMPRESSOR LUBRICANT CT-46. <br />OBSERVATIONS: <br />On July 21, 2020. An Estes Express rail car was leaking. After investigation, BNSF personnel determined the leak was <br />coming from a damaged container of petroleum compressor lubricant CT-46. The rail car was moved to the BNSF leaker pit <br />pending clean up by Patriot Environmental contractors on 07-22-2020. <br />Clean up all spilled material and dispose of it under all appropriate waste manifesting and waste disposal laws and <br />regulations. The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility <br />which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous <br />waste shall be disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Make a <br />hazardous waste determination for all waste materials and dispose of them as required, and provide proof of correction and <br />copies of waste disposal records to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />" Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />E Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />EHD 25-01 Rev. 08/17/17 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
