Complaint Investigation Summary Report #: 5105
COMPLAINT ID: C00053017 Site Location: JOHNSON RD & HVVY 12
Activity Summary
Activity Date Recorded by
11/25/2020 Received a copy of an email from James Hart (SJC Public Works Surveyors). MURO
Received an email from Anna Payan (SJC Public Works Surveyors) with a
Relinquishment letter from Caltrans relinquishing the right of way to San Joaquin
County. Forwarded this email thread to Elena Manzo, Melissa Nissim and Garrett
Backus. Requested guidance from Lead Senior Garrett Backus (EHD).
Forwarded Brian Closs the original email and asked if SJC Public works will be
responding to the oil dumping based on the information provided by SJC Public
Works Surveyors? Brian Closs responded to the email and wrote that they will be
responding Monday, 11/30 when Troy Botts, Road Maintenance Superintendent
returns. Troy will be providing direction on this matter.
11/30/2020 Prop 65 preparation, forwarded to have it mailed out. MANZO
11/30/2020 Discussed complaint with Elena Manzo.
Sent email to Troy Botts (SJC Public Works) for status update on oil dumping.
Forwarded all emails received from complainant to Troy.
Received phone call from Brian Closs letting me know that it is still unclear
whether the location of the oil dumping falls under county right of way. Public will
still clean up the oil as a courtesy. He will be notifying Cal OES.
Received reply from Troy Botts with letting me know that although it is not yet
determined whether the site of oil dumping is under county right of way, he has
given authorization for Public Works to cleanup the oil dumping.
Discussed Cal OES Spill report 20-6651 with Elianna Florido, (EHD). I called Brian
Closs at 209-468-3074 to find out if this was related to the complaint from last
week. Brian confirmed it was.
MURO
12/01/2020 Scanned to pdf the Prop 65. Emailed a copy to Troy Botts (SJC Public Works) as MURO
requested by Lead Senior Elena Manzo.
Troy Botts emailed to notify that San Joaquin County Public Works has addressed
the oily substance.
09/16/2021 Reviewed complaint file. MURO
Abating as in-office response. Listed items still required for complaint abatement
on a post-it note.
10/07/2021 Printed emails and letter from Department of Transportation with recorded maps. MURO
Compiled complaint file and submitted to Lead Senior Elena Manzo for review for
abatement.
5105. rpt
