Complaint Investigation Summary
Report #: 5105
COMPLAINT ID: COJISLPEO Site Location: NEAR 11 W ATHERTON ISLAND
Activity Summary
Activity Date Recorded by
09/21/2020 5:00 PM Received call from Kimberly Blackwell (EHD) 209-468-3427 to let me MURO
know she would be bringing me OES Spill Report #: 20-5290. Report states that
less than 5 gallons of refined clarity oil was released at 37.958178 - 121.352809
due to mechanical failure. Report states no water ways impacted.
Searched 37.958178 - 121.352809 on Internet and it appears to be on the San
Joaquin River.
5:14 PM Called person notifying OES, Tyler Shell (Project Manager at Shimmick
Construction) 510-393-0308. Tyler Shell stated that San Joaquin Area Flood
Control Agency (SJAFCA) contracted Shimmick Construction for the project. Tyler
Shell states that the material released was food grade biodegradable oil, and less
than 5 gallons released. He added that no water ways were impacted because
everything is contained inside the confined cofferdam. The released material was
surrounded by floating oil boom logs and will remain there until they are fully
saturated then will be removed and disposed of as non-hazardous waste. I
requested am SDS for the clarity hydraulic oil. Tyler Shell told me I would need to
contact SJAFCA and request through them. Their hotline number is:
209-487-1387. I asked for an address because we only received coordinates. He
stated he doesn't have an address but that the cofferdam is located near the Port
of Stockton with Country Club on the west.
5:21 PM I called Lead Seniors in this week's call-down list order: Michelle Henry
(EHD), Elena Manzo (EHD), Stacy Rivera (EHD) and Haza Saeed (EHD).
Briefed Haza Saaed.
5:40 PM I called Tyler Shell. He was there at the moment, but was getting ready to
leave. I requested a photo of the spill area. He told me that he would have to get
on a boat to go take a photo of the cofferdam. Tyler Shell told me he will be
sending me the SDS attachment via email. Reviewed SDS sheet. Section 12
states that the product has not been tested. Section 13 states that materials
contaminated with this product should be disposed in a manner consistent with
applicable regulations. Consult sales representative, local environmental or health
authorities for approved disposal or recycling methods.
Briefed Haza Saaed. It was determined we should wait for tomorrow first thing in
the morning to discuss with Lead Senior Elena Manzo since there will no longer be
people on site and a boat is needed to travel to cofferdam.
5:57 PM Called Tyler Shell to let him know I will follow up with him tomorrow. I
also told him my supervisor, Haza Saeed, said he does not need to take a photo
of the cofferdam since he is getting ready to leave area and will need to get on the
boat. Which was necessary to determine if I needed to go out this evening. Since I
do not have a boat, I will not be going to spill site.
6:00 PM END
09/22/2020 Called Tyler 510-393-0308, left a voice message, received a call back, discussed MANZO
waste disposal consideration for spilled waste/used oil substance, brought up my
concern about about the potential of contamination of the lubricating oil by metals
(since it spilled from a hydraulic piece of functional equipment).
Reviewed SDS provided for the spilled material (a petroleum based lubricating oil),
sent an email to Tyler providing waste determination code sections as well as
presumptive quality of used oil as hazardous waste, included HHW broshure,
advising to provide an adequate hazardous waste determination and waste
disposal documentation for this spill response.
5105. rpt
