Cal OES Spill Report #: 20-5946. <br />OBSERVATIONS: <br />October 24, 2020 Met with Patriot Environmental and observed about 120 feet of oil- impacted railroad, soil, and ballast. <br />Please be aware that all impacted soil and ballast shall be removed and disposed of under the appropriate waste <br />manifesting procedure [HSC 25160 (b)(3)]. The disposal of any hazardous waste, or the causing thereof, is prohibited when <br />the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD <br />in advance of any cleanup activities. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />E Other Correction <br />COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br />rate.
