Per Ralph a hydraulic line connected to a gas <br />well sprayed hydraulic oil onto gravel. When I arrived, the clean-up had already been completed by HydroChem. The <br />impacted gravel was placed into 2 black metal 55 gallon drums. The first drum was full of gravel. The second drum was <br />approximately 1/3 full of gravel, rags, and personal protective equipment. The drums were labeled as hazardous waste and <br />will be left on site to be disposed of at a later time. I observed staining on the gravel near the well cellar. Per Ralph and <br />Gerardo Gonzalez of HydroChem, the gravel was wet because Gerardo was pressure washing inside the well cellar. Per <br />Gerardo, he stated that he pumped out approximately 20 ounces of rinseate. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />Submit photo of the well cellar once it has an opportunity to dry to verify it was water. <br /> <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
