The following is an itemized list of hazardous materials violations that have not been addressed for 88 MARKET & GRILL as of December06 , 2021 . Open violations from October 112021 inspection Violation #2 - Failed to initially complete and electronically submit a HMBP . OBSERVATION A complete Hazardous Materials Business Plan was not submitted electronically to the California Environmental Reporting System (CERS) . REGULATION GUIDANCE: As of January 1 , 2013 , all businesses were required to submit all business plans electronically . CORRECTIVE ACTION : Immediately log into the CERS at http : //cers, calepa . ca . gov/ , enter the correct or updated information , and submit to the EHD for approval . ❑ This violation was corrected ❑ This violation will be corrected by ( date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #3 - Failed to establish and implement a hazardous materials business plan . OBSERVATION A Hazardous Materials Business Plan has not been established or implemented . REGULATION GUIDANCE: A Hazardous Materials Business Plan ( HMBP ) shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids , 500 pounds for solids , or 200 cubic feet for compressed gas , at standard temperature and pressure . CORRECTIVE ACTION : Immediately log into the California Environmental Reporting System ( CERS ) at http : //cers, calepa . ca . gov/ , enter the required information , and submit for review by the EHD . /Submit a statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented . ❑ This violation was corrected ❑ This violation will be corrected by ( date ) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #5 - Failed to electronically submit hazardous materials inventory for all reportable materials on site . OBSERVATION Twenty-one 15 pound propane cylinders (74 . 64 gallons ) were found on site that have not been reported to CERS . REGULATION GUIDANCE: Any material that meets or exceeds the reportable quantity shall be reported in the facility' s business plan . CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System ( CERS ) at http : //cers, calepa . ca . gov/, add the materials to the hazardous material inventory , and submit to the EHD for approval .
