Water Boards <br />November 5. 2019 <br />GAVIN NEWSOM <br />GOVERNOR <br />JARED BLDMENRELD <br />VSECRETARY EOR <br />ENVIRONMENTAL PROTECTION <br />State Water Resources Control Board <br />Division of Drinking Water <br />Jenny Haruyama, City Manager <br />City Manager's Office <br />333 Civic Center Plaza <br />Tracy, CA 95376 <br />RE: Proposed Church at 11075 West Larch Road <br />Dear Ms. Haruyama, <br />The State Water Resources Control Board, Division of Drinking Water (State Water <br />Board) and the San Joaquin County Environmental Health Department (County) have <br />received a request for the formation of a new public water system at 11075 West Larch <br />Road in Tracy, CA. Our understanding is that the new public water system would serve a <br />church that is in the planning stages with the County. The church would be located on a <br />parcel that has an existing residence currently served by City of Tracy (City) municipal <br />water service. The parcel appears to be in the City's Sphere of Influence based on a map <br />dated January 2012. The residential area along West Larch Road on the Sphere of <br />Influence map from 2012 indicates that this area is scheduled for annexation within the <br />next 10 years. Therefore, it is assumed the annexation will occur in the next few years. <br />We understand that several other small public water systems have already formed in this <br />area as well. <br />The State Water Board strongly discourages the formation of new small public water <br />systems, particularly in areas already receiving municipal water. It also has new authority <br />under Senate Bill — 200 to deny applications for new public water systems where <br />alternative water sources are available per California Health and Safety Code Section <br />116540(d). However, the State Water Board does not wish to impose itself in local <br />planning or limit projects desired by either the County or City unnecessarily. Therefore, <br />we request that the City, County and the Local Area Formation Commission consider how <br />to best deal with this project, existing public water systems and future projects so that <br />there is an orderly formation of municipal utility development in this area. <br />E.
