FINDINGS FOR DEVIATION <br /> PA-2100251 (DV) <br /> TRACY L. CLARKE TRUST/SHOUP LAND SURVEYING <br /> 1. The granting of the Deviation will not be materially detrimental to other properties or land uses in the <br /> area. <br /> • This finding can be made because the granting of the Deviation application will not have a <br /> detrimental effect on other properties or land uses in the area. The zoning of the property <br /> will remain Limited Agriculture,with a 5-acre minimum.The reduction in the minimum parcel <br /> size of 5 acres to 4.5 acres will not change the look or character of the neighborhood as the <br /> properties adjacent to the south and east which are also zoned AL-5 are less than 5 acres <br /> in size. Additionally,the reduction in minimum parcel size will not prevent the surrounding <br /> property owners from enjoying the full use of the property. <br /> 2. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the <br /> intended uses that do not apply to other properties in the same zoning district in the vicinity. <br /> • This finding can be made because other properties in the same zoning district in the vicinity <br /> are not as large as the subject parcel. The size of the subject parcel allows for it to be <br /> subdivided whereas other parcels with the same zoning in the vicinity are already below the <br /> minimum parcel size for the AL-5 zone. <br /> 3. The strict application of the regulation deprives the property of privileges enjoyed by other properties in <br /> the vicinity. <br /> • This finding can be made because the adjacent parcels,which are also zoned AL-5,are less <br /> than 5 acres in size. This nearly 20-acre property is the only property in the area that has <br /> not been subdivided.Allowing for the reduction in the minimum parcel size from 5 acres to _ <br /> 4.5 acres will allow for maximum residential development of the property. <br /> 4. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan; any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan; and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because, although the proposed 4.5-acre parcel size falls below <br /> the density requirement of the General Plan (one residence per 5 acres), the request falls <br /> within the 10% modification of lot area permitted with a deviation pursuant to Development <br /> Title Section 9-824.2(b). <br /> The proposed deviation does not otherwise conflict with the goals, policies, standards, and <br /> maps of the General Plan, Specific Plan,and Special Purpose Plan, nor any other applicable <br /> plan adopted by the County. The subdivision will result in 2 residences on one 4.5-acre lot, <br /> however, as one residence is a second unit dwelling,this does not conflict with the density <br /> requirement. <br /> PA-2100251 (DV)—Findings 1 <br />
