The following is an itemized list of hazardous materials violations that have not been <br />addressed for CHARTER WAY SHELL* as of November 17, 2021. <br />Open violations from November 03, 2020 inspection <br />Violation #11 - Failed to provide or document initial and/or refresher training to appropriate personnel. <br />According to Mr. Singh, hazardous material business plan training is not being conducted. <br />The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual <br />refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release <br />of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />Immediately provide employee training for appropriate personnel and submit a copy of the training records to the <br />EHD. <br /> <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Violation #12 - Failed to have the HMBP readily available to facility or EHD personnel. <br />The facility could not provide the Emergency Response Plan upon request. <br />The emergency response plans and procedures, the inventory of information required by this article, and the site <br />map required by this section shall be readily available to personnel of the business or the unified program facility <br />with responsibilities for emergency response or training pursuant to this section. <br />Immediately make arrangements to have the business plan readily available for review. <br /> <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Page 2 of 2
