The report was delivered to the business on 8/14/2018. <br /> REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br /> written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br /> subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br /> department or the local officer or agency may reasonably require,which shall include a statement documenting <br /> corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for <br /> purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San <br /> Joaquin County Environmental Health Department, requires response within 30 days. <br /> CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: An open Microgaurd box and a closed 15-liter FloTool drain pan was observed on top of the <br /> 55-gallon drum containing fuel contaminated liquid. Oil and oily stains were observed on and around the 55-gallon <br /> drum. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately manage the waste according to Title 22 California Code of Regulations for <br /> hazardous waste. Submit a statement and supporting documentation to the San Joaquin County Environmental <br /> Health Department describing the storage and final disposition of the cleaned up waste. <br /> This is a Class II violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: <br /> -One 55-gallon drum containing fuel contaminated liquid was observed with an open lid. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
