STANDARD PROVISIONS AND REPORTING REQUIREMENTS, JANUARY 2012 - 25 - FOR WASTE DISCHARGE REQUIREMENTS FOR DISCHARGES REGULATED BY SUBTITLE D AND/OR TITLE 27 verbally notify Central Valley Water Board staff and provide written notification by certified mail within 7 days of such determination, and within 90 days shall submit an amended report of waste discharge to establish an Evaluation Monitoring Program [Title 27, § 20385(a)(3) and § 20420(l)(1) & (2)]. J. RESPONSE TO A RELEASE 1. Measurably Significant Evidence of a Release Has Been Confirmed. If the Discharger has confirmed that there is measurably significant evidence of a release from a waste management unit pursuant to Standard Monitoring Specification I.46 or I.47, then the Discharger shall: a. Immediately sample all monitoring points in the affected medium at that waste management unit and determine the concentration of all monitoring parameters and constituents of concern for comparison with established concentration limits. Because this constituent of concern scan does not involve statistical testing, the Discharger will need to collect and analyze only a single water sample from each monitoring point in the affected medium [Title 27, § 20420(k)(1)]. b. Within 14 days of confirming measurably significant evidence of a release, the Discharger shall (for releases from MSW landfill units) notify all persons who own the land or reside on the land that directly overlies any portion of the plume of contamination if contaminants have migrated off-site if indicated by sampling of detection monitoring wells [40 C.F.R. § 258.55(g)(1)(iii)]. c. Within 90 days of confirming measurably significant evidence of a release, the Discharger shall submit an amended report of waste discharge to establish an Evaluation Monitoring Program meeting the requirements of Title 27, sections 20420(k)(5)(A-D), including but not limited to the results of sampling pursuant to paragraph J.1.a, above. The Evaluation Monitoring Program shall be designed for the collection and analysis of all data necessary to assess the nature and extent of the release and to determine the spatial distribution and concentration of each constituent throughout the zone affected by the release [Title 27, § 20420(k)(5) and § 20425(b)]. For releases from MSW landfill units, the Evaluation Monitoring Program shall also include any additional proposals necessary to comply with 40 C.F.R. § 258.55, particularly the additional monitoring well required by 40 C.F.R. § 258.55(g)(1)(ii). d. Within 180 days of confirming measurably significant evidence of a release, the Discharger shall submit to the Central Valley Water Board an initial engineering feasibility study for a Corrective Action Program necessary to meet the requirements of Title 27, section 20430. At a minimum, the initial engineering feasibility study shall contain a detailed
