11 <br />V4101 �40 <br />visual alarm or stops the flow of the hazardous substance at the dispenser when it detects a Ieak as <br />required by the California Code of Regulations, title 23, section 2636(0(1). <br />3 q. In the event that corrective work is required to address the cause of <br />4 an alarm in the UST system, Defendants will complete the work promptly, consistent with all <br />5 applicable legal requirements. Nothing in this Paragraph exempts Defendants from complying with <br />6 any and all statutes, regulations and any applicable local ordinances and permitting requirements or <br />7 any requirements for reporting, recording, or responding to unauthorized releases of hazardous <br />8 substances. <br />9 r. Defendants shall replace or repair any leak -detecting equipment, including <br />10 but not limited to leak -detecting sensors, that for any reason, become incapable of detecting an <br />11 unauthorized release from any portion of the underground storage tank system at the earliest possible <br />12 opportunity as required by California Code of Regulations, title 23, sections 2630(d) and 2641(a). <br />13 S. No person, agent, employee, or contractor, other than a Service Technician <br />14 meeting the requirements of California Code of Regulations title 23, section 2715(1), shall remove, <br />15 reposition, adjust, replace or otherwise touch or tamper with any leak -detecting equipment, including <br />16 but not limited to a leak -detection sensor that is part of a UST system such that the leak -detection <br />17 equipment is not capable of detecting a leak or release at the earliest possible opportunity, in violation <br />18 of California Code of Regulations, title 23, sections 2630(d) and 2641(a). <br />19 t. Defendants shall require every UST Facility employee to acknowledge in <br />20 writing that only a Service Technician meeting the requirements of California Code of Regulations <br />21 title 23, section 2715(f), can remove, reposition, adjust, replace or otherwise touch or tamper with any <br />leak -detecting equipment, no H&S employee shall disable or tamper with any UST automatic leak <br />2311 detection system that would prevent the leak detection system from detecting a leak or alerting the <br />owner or operator of the leak, including but not limited to removing, repositioning, adjusting, <br />replacing or otherwise touching or tampering with any leak -detection sensor; and that doing so may <br />constitute a crime pursuant to Health and Safety Code §25299(f) and will result in that employee's <br />termination. <br />U.
