CONDITIONS OF APPROVAL <br /> Tract No. 2246 <br /> ATC Realty Nine, Inc . <br /> Unless otherwise specified, all conditions of approval must be <br /> fulfilled prior to the approval of a final map. <br /> 1 . Planning Division: <br /> a. A noise barrier shall be constructed along the northern <br /> boundary of the proposed subdivision for noise attenuation <br /> per Section 9-9411 . The details of this noise barrier <br /> shall include a combination of berming, landscaping, and <br /> solid wall construction, and the barrier shall meet the <br /> minimum standards contained in the Fitzroy/Dobbs <br /> Acoustical Analysis. Height and type of construction <br /> materials, landscaping, and berm height shall be submitted <br /> to the Planning Director for approval . The height of the <br /> noise barrier shall either be a minimum of nine feet above <br /> the line-of-sight between the pavement and the road cen- <br /> terline and the property grade five feet inside the pro- <br /> perty line, or a minimum of seven feet above the line-of- <br /> sight between the pavement at the road centerline and the <br /> property grade at 75 feet south of the centerline, with a <br /> minimum 33-foot setback between the northern property line <br /> along Eight Mile Road and any residential construction on <br /> Parcels 1 and 23 . If this alternative is chosen, this <br /> minimum 33-foot setback shall be shown on the final map. <br /> In either case , the noise barrier shall be continued from <br /> the northern property line south along the east and west <br /> property lines to a point 11.3 feet from the centerline of <br /> Eight Mile Road. <br /> b. A preliminary copy of the Department of Real Estate <br /> Subdivision Report shall be submitted to the Planning <br /> Director which will inform first-time buyers of undeve- <br /> loped subdivision parcels that several different types of <br /> development fees may be required. The report shall <br /> j include the following statements: <br /> ( 1 ) Development fees and school fees of an undetermined <br /> amount will be passed on to first-time purchasers. <br /> (2) Homes located on Parcels 1 and 23 must be constructed <br /> to reduce noise levels to be consistent with the <br /> County Ordinance. <br /> (3) No residential construction shall occur within 33 feet <br /> of the northern property line adjacent to Eight Mile <br /> + Road on Parcels 1 and 23 . <br /> i <br /> c . In lieu of conveyance of park land to the County, as <br /> prescribed in Section 9-9261 of the Planning Title , the <br /> Conditions of Approval - 1 (Tract No. 2246) <br />
