g. The developer/owner shall participate in the Area of <br /> Benefit for the design and construction of the water and <br /> storm drainage systems . <br /> h. The area shall annex to North Morada County Service Area <br /> No . 46 prior to acceptance of the Final Map to provide for <br /> operation and maintenance of the storm drainage and <br /> domestic water systems. <br /> i . The subdivider shall agree to and shall pay service fees <br /> for the County-provided utility services in an amount <br /> equal to the estimated fees for the period from the accep- <br /> tance of the improvements until the effective date of <br /> assessment on the tax roll . Deposit of fees shall be sub- <br /> mitted at the time of acceptance of the facilities by the <br /> County. <br /> j . A Preliminary Soil Report shall be required. <br /> 4 . Air Pollution Control District : <br /> a. The following dust control measures shall be used during <br /> site preparation as well as construction period: <br /> ( 1 ) Grading shall be done during the spring while the <br /> ground is still damp from rain. <br /> ( 2 ) Water trucks and/or sprinklers shall be used as often <br /> as necessary to control dust . <br /> (3 ) Trees shall be planted on the site prior to construc- <br /> tion. These would act as wind breaks. <br /> (4) Water from an existing well shall be available for <br /> irrigation and dust control . <br /> ( 5) Instead of disking for weed control in the spring, the <br /> applicant shall mow, thereby leaving the ground <br /> undisturbed and with a mulch covering. <br /> b. Mitigation measures shall be taken to prevent fugitive <br /> dust from reaching adjacent streets. Sweeping of roads <br /> where dust has accumulated and cleaning of vehicles <br /> leaving the work site shall be required. <br /> c . All fireplaces shall have efficient combustion controls . <br /> 5 . County Counsel : <br /> Pursuant to Section 66474 . 9 of the Subdivision Map Act , the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, officers , or employees to attack, set aside , void, or <br /> annul an approval of the local agency, advisory board, appeal <br /> Conditions of Approval - 3 - (Tract No . 2246) <br />
