(c) Collect additional information, including sampling, monitoring, <br /> and analytical data for the purpose of making a determination as to whether <br /> the land should be designated as hazardous waste property or border zone <br /> property pursuant to Section 25229. <br /> (d) Hake a determination as to whether the land should be designated <br /> as hazardous waste property or border zone property pursuant to Section <br /> 25229. <br /> (e) Enter into an agreement pursuant to Section 25222. 1. <br /> (Added by Stats. 1984, Ch. 1736.) <br /> 25222. (a) In any case where the department has obtained information <br /> which shows that a significant disposal of hazardous wastes has occurred <br /> on, under, or in land and that the disposal creates a significant existing <br /> or potential hazard to present or future public health or safety, the <br /> department may consider designating the affected land as hazardous waste <br /> property or border zone property. <br /> Whenever the department considers designating land as a hazardous <br /> waste property or a border zone property, it shall issue and cause to be <br /> 6' served upon the owner of the land, and the legislative body of the city or <br /> county in whose jurisdiction the land is located, a notice of a hearing. <br /> The notice shall contain (1) a statement that the land is under consideration <br /> for designhtion as a haiardous waste property or a border zone property; <br /> (2) a summary of the reasons for that designation and what bignificadt <br /> existing or potential health hazards are believed to exist; (3) notice of <br /> the time, date, and place of the hearing, and any policy regarding continu- <br /> ance of the hearing; and (4) a fors to acknowledge receipt of the notice. <br /> (b) Service of the notice of hearing may be made in any manner permit- �. <br /> ted for the service of summons in civil actions, or by nailing a copy of <br /> the notice of hearing by first-class mail or airmail, postage prepaid to <br /> the person to be served, together with two copies of the notice of service <br /> and acknowledgment specified in subdivision (d) and a return envelope, <br /> postage prepaid, addressed to the department. <br /> (c) The notice of service specified in subdivision (b) shall be in <br /> substantially the following form: <br /> NOTICE OF SERVICE <br /> To: (Here state the name of the person to be served. ) <br /> The accompanying notice of hearing is served pursuant to Section 25222 <br /> of the California Health and Safety Code. Failure to complete this form <br /> and return it to the sender within 20 days may subject you, or the party on <br /> whose behalf you are being served, to liability for the payment of any <br /> expenses incurred in serving the notice of hearing upon you in any other <br /> manner permitted by law. If you are served on behalf of a corporation, <br /> unincorporated association, including a partnership, or other entity, this <br /> form must be signed in the name of that entity by you or by a person author- <br /> ized to receive service of process n behalf of that entity.
