(b) By entering into Lhis agreement weth rv%pert to a portion of a <br /> property, the department is not precluded from laking action to designate t <br /> the remainder of the property as hazardous waste or border zone property. <br /> (Added by Stat. 1984, Ch. 1736. ) <br /> 25223. Public notice of any hearing conducted pursuant Lo Section <br /> 25222, or of any agreement proposed to be entered into pursuant Lo Section <br /> 25222. 1 , shall he provided by the department at least '10 days hpfore the <br /> hearing or execution of the agreement. The notice shall lie given by publi- <br /> cation once in a newspaper of general circulation published and circulated <br /> in the locale or, if there is none, by posting Lhe notice in at least. three <br /> public places in the locale. In the case of a proposed agreement, the <br /> department shall also give notice to the city or county in whose jurisdicLino <br /> the property is located. Public comment on any proposed agreement pursuant <br /> to Section 25222. 1 shall be submitted to the department in writing. <br /> u (Amended by Stats. 1984, Ch. 1736.) <br /> q) 25224. The hearing shall be held before the director, or any agent or <br /> agency designated by the director for that purpose, not less than 30 days <br /> or more than 90 days after the notice. The department may delay the hearing <br /> upon request of any interested person. <br /> (Amsnded by Stats. 1984, Ch. 1736.) e <br /> 25225. The department may consolidate into a single hearing Lhose <br /> hearings which affect a hazardous waste property and any associated border <br /> zone property. Notice of such consolidation shall occur as soon as practi- <br /> cable, but not less than 15 days before the hearing. <br /> (Added by Stats. 1980, Ch. 1161.) <br /> 0 <br />' 25226. The persons served shall have the right to file a response to <br /> the notice and to appear in person or otherwise and give testimony at the <br /> place and time fixed in the notice. At the discretion of the director, <br /> agent, or agency conducting the hearing, any interested person may be <br /> allowed to intervene in the proceeding and to present testimony. Any such <br /> proceeding shall, so far as practicable, be conducted pursuant Lo the <br /> provisions of Chapter 5 (commencing with Section 11500) of Part 1 of Divi- <br /> sion 3 of Title 2 of the Government Code. All proceedings shall be appro- <br /> priately reported, and the testimony taken shall be reduced to writing and <br /> filed with the director. Thereafter, at his or her discretion, the director, <br /> upon notice, may take further testimony or hear argument. <br /> (Added by Stats. 1980, Ch. 1161 . ) <br /> 25227.
