pgU,[N SAN JOAQUIN COUNTY
DEPARTMENT Of PUNNING AND BUILDING INSPECTION Item No. 1
Q /
NI <
1610 E. HAZELTON AVE.. STOCNTON, CA 95205 CHET DRVISSON
PLANNING PHONE: 209/9443722 Di,.tw
cq tikP BUILDING PHONE. 209/9443701
o JERRY HERZICK
Deputy Dimto,
TOM WALKER
DePuq DirKw
March 19, 1987
MEMORANDUM
TO: Planning Commission
FROM: Chet Davisson, Director
SUBJECT: MAJOR SUBDIVISION APPLICATION NO. SU-86-10 OF WOODSON
ESTATES (C/O BAUMBACH & PIAZZA) FOR AN APPEAL OF
STAFF'S DETERMINATION TO REQUIRE A "SUBSEQUENT"
ENVIRONMENTAL IMPACT REPORT FOR AN 81-LOT RURAL
RESIDENTIAL SUBDIVISION. LOCATED ON THE NORTHWEST
QUADRANT OF STATE ROUTE 99 AND JAHANT ROAD,
COLLIERVILLE, NORTH OF LODI
----------------------------------------------------------------
RECOMMENDATION:
1 . Deny the appeal and uphold the requirement for the prepara-
tion of a "subsequent" Environmental Impact Report (EIR) ,
based on Section 15O64 (a) ( 1 ) of the California Environmental
Quality Act (CEQA) Guidelines and as further described in the
"Response to Appeal" section of the attached staff report .
2 . Further, deny "without prejudice" Major Subdivision
Application No. SU-86-10, based on expiration of the one-year
maximum processing time permitted by Government Code Section
15108 .
BACKGROUND:
This item was continued from the Planning Commission hearing of
December 4, 1986, at the request of the applicants . The appli-
cants indicated at the time that they were considering possibly
redesigning the project as a Planned Unit Development to avoid a
conflict with the airport zone proposed for Lodi (Lind' s) Airport
to the south.
At the time of continuance , it was noted that this would be the
last continuance possible before the one-year time limit expired.
Some action must be taken at this time to prevent an "automatic
approval . "
Staff assumed that the developer was working on design alter-
natives during this time period - specifically, a design solution
addressing identified air safety and toxic waste concerns.
