Box 1810 <br /> Stockton, CA 95201 <br /> COUNTY OF SAN JOAQUIN AND FOOTHILL SANITARY LANDFILL, INC., <br /> FOOTHILL SANITARY LANDFILL, MUNICIPAL SOLID WASTE (CLASS III), SAN <br /> JOAQUIN COUNTY <br /> Enclosed is the Cleanup and Abatement Order(CAO)No. R5-2004-0706, Administrative Civil <br /> Liability Complaint (ACLC) No. R5-2004-0520 and Settlement Agreement(Agreement). The <br /> formulation of these documents resolves ACLC No. R5-2004-0520 (which replaces ACLC No. R5- <br /> 2003-0159). <br /> ACLC No. R5 2003-0159 alleged a violation of Waste Discharge Requirements (WDRs) Order No. <br /> R5-2003-0020. Following the issuance of the WDRs, the County of San Joaquin and Foothill <br /> Sanitary Landfill, Inc. (Discharger) submitted the Engineering Feasibility Study(Report). The <br /> ACLC No. R5-2003-0159 stated that the Report did not include the closure of Module "I" in <br /> compliance with Title 27 California Code of Regulations (Title 27 CCR), Division 2, Subdivision 1, <br /> as required by the WDRs Order No. R5-2003-0020. The ACLC No. R5-2003-0159 proposed to <br /> impose $10,000 in civil liability on the Discharger. <br /> Settlement negotiations,ensued. The Discharger and the Executive Officer reached an agreement to <br /> resolve by consent and without further administrative proceedings the alleged violations of the <br /> CWC and WDRs. The Discharger agreed to pay$10,000 in proposed civil liability and the <br /> Executive Officer agreed to revise the ACLC No. R5-2003-0159 (the new order is ACLC No. R5- <br /> 2004-0520). The Discharger further agreed to accept CAO R5-2004-0706,which is intended to <br /> address releases from Module "l," and the Executive Officer agreed, if landfill gas releases are <br /> successfully eliminated, to recommend a modification of WDRs Order No. R5-2003-0020 to be <br /> consistent with CAO R5-2004-0706. <br /> Please note that the CAO requires the County of San Joaquin and Foothill Sanitary Landfill, Inc., to <br /> submit a number of reports.
