Box 1810 <br /> Stockton, CA 95201 <br /> NOTICE OF VIOLATION <br /> RE VIE W OF THIRD QUARTER 2002, FOURTH QUARTER/ANNUAL 2002 AND <br /> SEMIANNUAL 2003 MONITORING REPORTS,FOOTHILL SA-ATITARYLAAWFILL, SAN <br /> JOA Q UlN CO UNTY, FA CILITY#5B390300001 <br /> We have reviewed the record for the Foothill Sanitary Landfill and find that the majority of the reports <br /> were submitted late in accordance with applicable Waste Discharge Requirements (WDRs) Order Nos. <br /> 94-258 and R5-2003-0020. Based on the minimum standards set forth in WDRs, the Regional Board <br /> has determined that the San Joaquin County Department of Public Works is in violation for submitting <br /> required reports after the due dates. We also are finding information in the reports to be incomplete. <br /> The following comments itemize our major concerns on the subject documents: <br /> 1. P Quarter Monitoring Report was due 15 October 2002 pursuant to WDRs Order No. 94-258 <br /> which states, "Quarter monitoring reports shall be submitted to the Board by the 15th day of the <br /> month following the calendar quarter in which the 'Samples were taken." The Report was received <br /> late on 10 December 2002; therefore the County is in violation of the WDRs. Please see the <br /> attached Checklist with more detailed comments on the report. <br /> 2. 4th Quarter/Annual Monitoring Report was due 15 January 2003 because of the 4th quarter due date <br /> as in Comment 1. WDRs Order No. 94-258 does not specify when the Annual report must be <br /> submitted. In this regard,we normally expect 4`h Quarter/Annual combined reports be submitted <br /> when the 4th quarters are due. The Report was received late on 9 April 2003; therefore the County <br /> is in violation of WDRs. Please see the attached Checklist with more detailed comments on the <br /> report. <br /> 3. As discussed in more detail in the attached Checklist for 0, Quarter/Annual 2003 Monitoring <br /> Report (Report), it appears that information is physically left out of the documents and references <br /> to particular monitoring wells are inaccurate.
