In accordance with Title 27, California Code <br />of Regulations, Section 22225, a demonstration of the minimum fund balance calculation must be <br />submitted to the California Integrated Waste Management Board (CIWMB) by the anniversary date of the <br />fund. The last report was submitted to CIWMB on September 22, 2008 for the period of August 1, 2007 <br />to July 31, 2008. A copy of the report was also submitted to water board staff. In that report, the closure <br />cost estimate was increased by the 2007 inflation factor, as required by the CIWMB, to $22,749,281. The <br />fund balance was $3,381,729.86. We have not received comment from the CIWMB and assume that this <br />amount is adequate at this time. <br />Postclosure <br />Postclosure maintenance funding is provided through CIWMB's Pledge of Revenue Agreement 94-1137. <br />Operating Liability <br />Financial assurance for operating liability is provided by a non -expiring certificate of Self-insurance and <br />Risk Management. This certification has been previously submitted. <br />Corrective Action <br />We are pleased to report that the financial assurance for corrective action at FHSL is now demonstrated <br />through San Joaquin County's pledge of revenue resolution R-08-686 passed by the County's Board of <br />Supervisors on December 9, 2008. A copy of the resolution is attached. <br />
