CAL OES CONTROL #: 21-1801. <br />OBSERVATIONS: <br />On 4/5/21, EHD received notification of a 100-gallon diesel fuel spill that occurred on 4/2/21. The spill was due a damaged <br />saddle tank on a semi truck (Mike Lowrie Trucking). Observed spill area was approximately 15 x 30 feet in area and <br />approximately 12 feet west of the railroad. Absorbent was applied to the diesel spill area. Spill site is pending USA Dig <br />clearance (initiated on 4/5/21) for removal of impacted soil. Please be aware that all impacted soil has to be excavated and <br />disposed of under the appropriate waste manifesting procedure [HSC 25160 (b)(3)]. The disposal of any hazardous waste, <br />or the causing thereof, is prohibited when the disposal is at a facility which is not permitted or authorized for hazardous <br />waste disposal. [HSC 25189.5 (a).] Notify EHD (48-hours) in advance of any cleanup activities. Provide disposal records for <br />all generated wastes. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Li Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
