SAN JOAQUIN <br /> <br />Environmental Health Department <br />Y <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: HUB GROUP <br />Date: Jul 06, 2020 <br />RP Mailing Address: 700 COMMERCE DR <br />Record ID#: COHARDVZC <br />OAK BROOK, IL 60523- <br />Program Element: 2546 <br />Spill Location: 1000 E ROTH RD, FRENCH CAMP <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately ten ounces of petroleum road oil released from container number HGIU508503. <br />OBSERVATIONS: <br />On July 5, 2020, container HGIU508503 was releasing a slow drip of petroleum road oil onto the ground. The container was <br />then moved to a leaker pad in the rail yard to contain the release. There was no impact to water ways. <br />Cal OES Control #:20-3562 <br />Clean up all spilled material and dispose of it under all appropriate waste manifesting and waste disposal laws and <br />regulations. The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility <br />which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous <br />waste shall be disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Make a <br />hazardous waste determination for all waste materials and dispose of them as required, and provide proof of correction and <br />copies of waste disposal records to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />cl Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />1' Investigate and abate contamination under the oversite of the appropriate lead agency. <br />lmmediatley. <br />Submit copies of hazardous waste manifests/disposal records to the END. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 08/17/17 Page 1 of 2 <br />1868 E.
