In determining whether a violation is <br /> chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including <br /> corrective action) . <br /> On 5/26/2021 and 5/26/2022 Carol Presto of the San Joaquin County Environmental Health Department (EHD) performed a routine undergroun <br /> storage tank inspections at the above reference site . The site was found to be out of compliance . The outstanding violations include but are not limite <br /> to the following : <br /> - On the 5/30/2019 and 5/18/2020 inspection reports , the facility was cited for not having approved overfill on all tanks . An Overfill Prevention Equipmen <br /> Inspection Report Form was submitted to EHD on 5/ 12/2020 for testing conducted on 5/2/2019 but 48-hour notification was not provided for the test <br /> work orders for the test and a copy of the results were not on site during the 5/18/2020 inspection . The overfill equipment listed on the result was OP <br /> 61 SO but flappers were not observed during the 5/18/2020 and 5/26/2021 inspections . New Franklin Fueling Defender drop tubes were installed unde <br /> permit number SR0083186 but by a technician not certified by the manufacturer. The installed drop tubes failed initial testing on 10/6/2021 and have ye <br /> to be re-tested showing passing results . <br /> - On 5/26/2022 the diesel leak detector failed to detect a leak when tested . On all Designated Operator reports observed , starting 11 /8/2021 , a W1 <br /> WPLLD communication alarm has been noted as in alarm but has not yet been addressed . The alarm history observed during the inspection shows th <br /> initial W1 WPLLD communication alarm on 10/22/2021 . <br /> - During the 5/26/2022 inspection , dispensers 1 /2 , 11 /12 , 13/14 , 15/16 , 17/18 , 19/20 , and 21 /22 were observed with piping located outside of the unde <br /> dispenser containment (UDC) that would not allow leaks to flow back into the UDCs .
